Another Assessment before Appeal was created by Marty
I am waiting for an appeal date and have complained to Atos about the inaccuracies in the Assessment report and the fact that the Assessor said I declined a couch examination which I didn’t.

This afternoon someone rang to arrange for another Assessment in my home! I was not really wanting to go through another Assessment again. Is that normal? I was complaining really to make Atos aware of the way their Assessors are not being honest - I was not really wanting another Assessment. They are so stressful.

I would start by contacting the DWP about the assessment to see whether it has been ordered by them or not, it's not unknown for ATOS to do these things of their own back.

If the DWP have ordered a new assessment then I'm afraid you probably do not have any choice but to attend, unfortunately the PIP legislation allows a reassessment at any time and for any reason. You need to understand whether this is a reassessment of your existing award or a new assessment to replace the one that you complained about.

You will have to wait and see how this might effect your appeal.

HI Gordon

Thanks for your quick response.

I got a long letter this morning going through all the points I raised in my complaint and it seems the reassessment is just to address points which they agree weren't covered correctly so I guess it is a reassessment of my existing award? It didn't actually specify in the letter other than I would have another assessment at home.

I still don't know how this affects my appeal but I suppose I shall just have to wait and see what happens?

Hi Gordon

I have just phoned the DWP and it is as per their request. A new assessment. I asked how that will affect my appeal and she said in these cases, often the appeal is avoided so it might work in my favour but she wasn’t a case worker so couldn’t say for sure!

A strange situation

I don’t know what to think really. I really wasn’t expecting this.

If as a result of the assessment the DWP make a new award that is more in your favour then the existing appeal can be lapsed, however if this happens then you would have a new right of appeal and can still challenge that new award if you wish.

In some cases the DWP may offer you a new award but if you do not accept it, allow you to continue on to appeal.
