Pip, capita liars didn’t attend, next steps.

Sorry I can’t find my previous post. I’m supposed to have had two assessments thus year, capita didn’t show for either, They’ve said they did attend the second and given an accurate description of the front of my house.....all the info of which could be found on google street view.

I have filed a complaint with capita, well my friend has on my behalf, over the phone, having spoken to the dwp today and been told that no decision has yet been made however “why would an assessor give a description if they hadn’t been” its extremely likely my Dla will be stopped and pip refused.

As a follow up to my complaint to capita I have printed screen shots of google street view showing my hose, location services from my phone showing I was home at the times in question and phone logs of calls to both capita and the dwp. I intend to send these both to capita and to my mp (unfortunately that is Ben Bradley who has been in the Lakers again this week I gather).

What else should I do?

I saw my gp on Saturday and warned him the dwp might get in touch however the case manager my friend spoke to today said that even if the case manager who makes a decision sends my file back to capita for further assessment it is extremely unlikely that capita would bother to contact anyone and I should send them any extra info I can now get. So I guess I’ll be paying gp and psychiatrist for letters over the next couple of weeks. Silly me thought putting everyone down on the form for dwp to contact would be sufficient and save myself a lot of money.

Any further advice please? I have read the guides, used them to complete the form initially and left nothing out on it.

To be honest there is little else that you can do until you hear from the DWP. I think using your phone location is a clever idea as is involving your MP.

My friend phoned the DWP again yesterday and although due to the adverse weather there were no case managers in apparently the person who answered the phone said that my claim had been “disallowed” as I didn’t attend my medical. They sent a letter on the 20th apparently, however she said that due to the weather it’s unlikley I’d have received it, would not tell us what said letter said and would not tell us why this letter was not mentioned when we last rang on Monday.

I’m not actually sure what my claim being disallowed means, though I’m assuming it means my Dla has been stopped (it is due again on tuesday if they pay it this time, the original end date of the award) and presumably I have been refused pip. Does this mean I will have to ask for and appeal or does the disallowing rather than simple not getting an award mean I need to start over?

I'm afraid it means that they are refusing your PIP claim and as a result your DLA will be stopped four weeks later.

You have two choices going forward, you can challenge the Decision by going to MR and appeal if necessary or you can make a new claim for PIP immediately, there is no waiting time.

The postman has just this minute brought a letter saying the same.

In your experience what’s the likelihood of MR getting a result when they’re still saying I didn’t co-operate?
I’m tempted to chuck an MR request letter in with my “formal complaint” which includes the info and call logs from my phone that went to capita too. I know they have no time limits over how long they take to do an MR but I can dream that my phone logs showing we were on the phone to capita until 11minutes before the hour they told us to wait and everything else might make them think again.

I think you have good evidence but that does not always make a difference with a DWP Decision Maker who don't always exercise their right to make a decision.

This is all about the facts of the situation as opposed to a judgement call about how you meet the activities so it should be a quick Decision to make, a new claim should be subsumed into your original claim if the Decision is overturned. So think about doing both.

Your DLA may be a further problem. The DWP seem unable to comprehend that a positive Good Cause Decision means that the Decision to stop your DLA did not actually occur and therefore there is no reason to have stopped your DLA, so overturning the Decision that you did not co-operate may still mean that you have to do another MR to re-instate the DLA.
