I have been on IB and ESA (support group) for the last 20 years. I have never had an issue until now. This time round they have decided I should be placed in the WRAG. I have calmed down enough now to attempt to work out what had happened. I believe I have always gone into the support group on the "danger to self or others" exemption. However since the last assessment I have very discharged by my psychiatrist because she could A: do not more for me and B: budget cuts.

I now have 3 weeks to provide more evidence which if course excludes a referral back to the psychiatrist. My GP is reluctant to see me and write a report (my actual GP of many years recent retired) so my question is would it go against me if I paid a private GP for an assessment and written report?

I just don't know what else to do in such a short space of time. I have requested a statement of reasons from the DWP and have an appointment with the CAB to help me fill in the reconsideration form but really feel the lack of medical evidence has let me down.

There are two issues you need to deal with if you are hoping to qualify for the SG through the Substantial Risk Regulations.

The DWP have updated their guidance for this in the last couple of years and it is now much more difficult to qualify through this route. See our ESA Claim guide for the changes.

Secondly, there is no on-going presumption of disability for these Regulations, claimants need to show that they meet the criteria from scratch each time they are assessed.

There should be no issue with you paying for a report but make sure that it actually addresses the criteria for the SG many doctors think they only have to show that you cannot work and this will not be sufficient.

I had not seen a doctor for over 3 years when it came to having to claim PIP....I was no especialy fond of my doctor any wayand furthermore had relocated. & was with new practice. I commissiojn a full psychiatric report from a psychiatrist who i found online. He with my consent obtained my full records from my doctor & I had an hour long consultation with him,. He was very good and produced a very very full mental health report on me to go with my claim. I was awarded standard on both for 10 years and had previously only been in receipt of lower rate DLA for life. It was £400...but obviously in my case money well spent

Thank you that's very useful. I should have done this as soon as the envelope landed on the mat but I stupidly assumed I would sail through as usual. The problem I now face is gathering supporting evidence within 2 weeks. Is there any way to get an extension on the one month mandatory consideration limit to allow for this does anyone know?

You have two options;

- Make the MR request as late as possible, the one month is for the DWP to receive the request, and tell them that you need more time to source additional evidence. The DWP should allow you a further four weeks to do but again this is for them to receive it so in reality, you must send it no later than the three-week mark.

- Alternatively, you can make a Late request, outside of the normal one month, you will need to explain why the request is Late, you trying to provide additional evidence should be accepted as Good Cause for the delay but if it isn't you will have to go on to appeal. Just to reassure you, I can't remember the last time a Late MR request was rejected.
