To Tax, or not? was created by Sheilamoose
Hiya everyone
Sorry if I’m being a pita (or thick?) but trying to get my head round the road tax situation on our poor old car...
It is taxed under DLA exemption certificate till June 2019, but gather that certificate is null & void once PIP have made a decision; have had PIP result & as I feared have gone from High Care & High Mobility to Standard Care & Standard Mobility (fractionally over half the money previously received). A couple of weeks ago I was ill on a Saturday, so went to A&E, who promptly admitted me & kept me in for a week – hubby (bless his cotton socks) rang PIP on the Monday & “a lovely, kind, sympathetic, lady” granted him a 4 week extension for me to get my Mandatory Review paperwork in as might miss the deadline.
Back to car tax... do I pay ‘half-rate for 6 months’ while waiting for Mandatory Reconsideration decision – technically, have PIP made a decision if someone else is looking at it again? Or would it be better to pay for 12 months? I will appeal any PIP decision that is not Enhanced/Enhanced but unsure on Tribunal waiting times – live in Suffolk.
Looking to the future, if I win any Tribunal, can I claim back any car tax I was ‘forced’ to pay (to comply with law) which I did not actually have to pay for as I was exempt? Have looked everywhere but can’t find an answer to this one anywhere.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Although this question gets asked quite frequently on the forum I'm afraid that there are no definitive answers available on the internet and in particular on the DVLA website, so you are going to have to contact the DVLA directly.

Thanks Gordon, any help always appreciated. Hubby says pay for 12 months, in case PIP Tribunals have a long waiting list.
This '50% off' system, although greatly appreciated and covers anyone who gets Standard Mobility (unlike DLA Higher Rate Only) - (a) must be a headache for the poor staff at DVLA who have to manually process everything; (b) is not very well advertised at all! - must be hundreds/thousands of people driving around who are paying twice the required amount for their road tax but are oblivious due to poor advertising. Thinking about writing to Mrs May, suggesting a paragraph be added to the PIP Award Letter, informing people to their right to 50% Road Tax & how to go about getting it! The Award Letter mentions Blue Badge & Disabled Person's Railcard -so- why not Road Tax???
