Just got my DLA to PIP result - Zero Points

6 weeks after At Home Assessment - I have today had my PIP result. I was previously on Middle Care with DLA but my conditions have greatly worsened since them. The result ZERO points for everything my scoring was easily middle to high on both. And so the fun begins! I am totally exhausted from my current condition and now I have to battle on. Do give zero points for everything is incredible but perhaps the biggest joke of all is where they mention twice - there was NO anxiety, agitated, tense, restless, or withdrawn - when I burst out crying several times throughout the interview as I recalled my struggles. The upper limb test was done with feather light resitance but more importantly the lower limb task I could not attempt or complete and yet is says no problem. I'm speachless and so as I said the fun begins. Its not even honest!

Sorry to hear you have been unsuccessful.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Thank You. I had already rung for the report in tears and can only hope it gets here sooner than the decision letter which was dated 1.11.2018 and got here 8.11.2018 but a good reminder from you to also request in writing. I am now going through my interview as I recorded it and have not listened to it since. The nurse kept saying all the way through "Oh bless you" and "don't worry" - it should make an interesting read as Zero points beggars belief. The decision maker has also put that I have no significant specialist input or medications for arthritis CFS or ME. I have been on Pain Management courses but needless to say they are not ongoing as NHS don't fund it like that. It was on the course we where advised to claim DLA as it was. My body cannot tolerate the many drugs they dish out for such conditions and I use alternative therapies. Anyway thank goodness for all the advise to follow although I wish they had been sensible as I feel sure they may well end out paying more as a result in the end. Onwards until the interesting report comes. Thanks again

I have bi polar and other mental health issues. In my assessors initial report she said I had no anxiety maintained eye contact no sweating fidgeting etc....got nil points. When I asked for an MR I pointed out that anxiety is not always shown in a 'theatrical way'....mental ill health is often invisable. I probably wasnt a jibbering wreck....but far more to mental ill health than that.My psychiatrist wrote a further supporting letter and pointed out that she was not qualified to carry out a mental health assessment. She was a paramedic. I was awarded standard on both elements for 10 years

Received the result of my MR today. It took them 11 weeks but once again zero points so it looks like here we go for appeal! The decision seems very generic and like the original decision when it mentions anything it acknowledges the condition then seems to state that is no significant impact. " You were observed to have some discomfort in your back when bending and on completing the neck movements and were unable to complete the squat movement however observations noted no significant sign of fatigue or other signs of discomfort and you did not look tired" Hilarious. "Although you reported being unable to walk more than 200m you reported that you are able to walk around a supermarket aided" Even more hilarious as I reported that all my shopping is delivered at home. The most hilairous (!) thing being throughout the interview I cried and said how distressed I was about appealing and she said "Don't worry that won't happen this time" Onwards and upwards.
