PIP reconsideration declines

Has your friend completed a Mandatory Reconsideration? This is the first stage in challenging a Decision. If not then this needs to be done. Our PIP MR Appeal guide explains what needs to be done and there are template letters you can use in the MR & Appeal submissions document.

If an MR has been completed then the next stage is an appeal. The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send your friend a copy, whilst she should wait until you receive this to finish and submit her own, you should start to prepare her own case, an award will only be made by your showing that she scores the points for one, so I would start by going back through her PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

She originally had the benefit as she has Bi polar, the medical person just spoke about her back complaint and not about her mental health illness. I don't know where to go with this.

If she did not record how her Bipolar limits her ability to complete the PIP activities then those assessing her will not have considered them, even if her problems were recorded in a previous form. Unfortunately, she is going to be playing catchup, however, an appeal panel has a much more balanced approach to looking at claims.

I have to mention it, with appeals taking nine months or more across most of the country, if no award was made, have they considered making a new claim for PIP, there is no waiting time?
