Hi can anyone advise me please. I’m in receipt of contribution based esa having transitioned from incapacity benefit. I recently had a letter saying I might be entitled to income based esa as well and it would be backdated to 2013 when I was moved over. I have since received a payment which I think is for the enhanced disability premium it’s just over £15 a week. My question is should I be able to claim the severe disability premium as well, and also have that backdated. And this is where it gets complicated. I split from my husband in 2005 but neither of us could afford to move out so we both still have the same address but do not share anything,we are permanently separated, he’s not here most of the time as he goes to girlfriends quite often. At the time we were joint tenants of the house, the house has since been purchased and we are both now joint owners. I also get dla higher rate mobility and middle rate care. Any help would be gratefully appreciated

To receive the SD Premium you need to be receiving Income Related ESA, have an enabling benefit such as your DLA MRC, be living alone or considered to be living alone and no one must be receiving Carers Allowance against your DLA.
From your post, your husband has been living with you.
To be considered as living alone your husband needs to be receiving an enabling benefit as well or they need to be considered as being financially independent from you, you may be able to show the latter but you will need the assistance of a trained advisor as you need someone who can act on your behalf with the DWP.
Do an internet search for "welfare advice" with your postcode, town or county.
