DWP PIP APPEAL THEY LOOKING AT IT AGAIN was created by terdun9
Hi Gorden and co.
I got 2 letters today saying they the dwp look like they are going to appeal my appeal,
and because I also care for my husband as well, they are appealing that questioning how i can do it due to my disabilities as well,
so now I am wondering just what to do like I said to them on the day we are married he and I look after each other if it is helping him shower as he does me it doesn't matter to me if I get paid for it or not this is how we live.
so I really don`t know what to think now this has been 19 months now from inviting me to apply for the PIPS from DLA to appeal to now this.
as it reads it looks like they have till the 15 dec to ask for an appeal open the tribunal's decision. OH will this ever stop? I just wanted to let people know here this is what it looks like they are doing to people now.

Like you the DWP have a further right of appeal to the Upper Tier Tribunal. They cannot appeal because they disagree with the Decision, only because they believe that they can show that there was Error of Law in the making of the Decision.
What is an Error of Law?
As the first stage to this process, they will request a Statement of Reasons from the Judge who was in charge of your hearing, you will receive a copy of this. Just because they have requested a SoR it does not follow that there will be an Error and if there is not then they will have to implement the Tribunal's Decision. If they do then they will apply for a UTT hearing ut even then it may still be refused.
