Hi,
I have a question regarding moving between two local authorities and the potential effect on my ESA, I currently live in North Tyneside and may be moving to South Tyneside, NTC has not switched to UC and I get ESA including Dis Prem and Severe Dis Prem, STC has switched to UC and I have been advised I would need to start a new UC claim. By doing so would I stop receiving the disability premiums or would I keep them because I already get them ? My understanding is that if I stay in NTC's area I will keep the premiums when NTC switches to UC because I already get them, so would the process of moving to STC, thus effectively taking myself off ESA, and putting myself on UC of my own free will, see my premiums stopped because it is a new claim? Your insight into this matter would be greatly appreciated as always, many thanks in advance. K o p.

First of all, you only need to claim UC if you need to make a new claim for one of the benefits that it covers if you move to STC. Typically this is Housing Benefit but if you don't need to claim HB or any of the other benefits then your ESA will remain in payment.

At the moment the UC legislation provides no Transitional Protection for claimants who need to make a new claim for UC, however, there is draft legislation that should be in place sometime in January (currently) that will, claimants who have already moved will receive some form of back payment.
