My son who is my unpaid carer due to waiting for over a year for my pip tribunal and also awaiting for outcome from recent wca has received a message from his work coach that he has been moved into the intensive work search regime as I don’t get Carers Allowance and he has also been sanctioned until he attends a commitment review. My anxiety is now in overdrive as I can’t cope on my own I need him with me. Is there anything he can do apart from end his claim ?

You don't need to be receiving Carers Allowance to receive the Carers Element under UC but the person being cared for must be receiving an enabling benefit such as PIP otherwise they will have no entitlement.

I can't tell from your previous posts whether you have an award of PIP and are appealing for a higher one or you don't have one and are appealing for one. If the former then your son needs to provide proof of this to his JC+ advisor, If the latter then I'm afraid there is little that he can do but comply to avoid further sanction.

I was in receipt of daily standard pip but after review I got nil points so I’ve appealed it, this was July 2017.Went to tribunal but it was adjourned, for my medical notes which have recently arrived, so I’m just waiting for a new date. Also waiting outcome of wca...I’m constantly waiting ! And now this drama has tipped me over the edge. He has been getting uc since April no problem so don’t know what’s changed. He hasn’t claimed Carers Allowance before for me, in fact he wasn’t claiming anything till April this year

The only thing I can suggest is for your son to contact the JC+ advisor directly and explain the situation with your appeal in the hope that they will defer the requirement until you have a Decision on your appeal.

Thank you Gordon, he has an appointment this week.
Can I ask do you know if you can put in a new claim for pip while waiting for tribunal ? It’s been over a year now and trying to survive on £317 minus deductions each month is making me ill.

You can make a new claim for PIP at any time but the new Decision that will result from the claim will limit any award that you might receive from your Tribunal, plus you will still need to address the issues that mean that you had to appeal in the first place.
