Hi, My son has been sent this form to fill in. I normally fill forms in because of his health condition. But this year I have been too unwell to do anything such as filling in forms.

I do not believe that my son is entitled to a top up. so would sending the unccompleted form back along with a short explanation stating that I cannot fill in the form because of poor health?

Hi Gordon, thanks for your reply. I've read it, it does not cover what I'm asking.

From the link

You do not think you qualify
If you are certain that throughout the period in question you are not eligible for ESA(IR) then you can return the form uncompleted, the DWP for there own records will want a reason for this, you can either tick one of the boxes that they supply or add your own explanation.

Thank you Gordon for your reply, in your opinion, does the reason for not filling in the form as being too unwell qualify as satisfactory?

I'm only asking for your opinion based on the much more knowledge you have on the subject.

Phil

Either your son is not eligible for ESAIR) throughout the period in which case there will be a reason for this and it this that you should specify when you return the form uncompleted, or he does meet the criteria or at the least may meet it in which case I would have thought that you should be talking to the DWP about your problems completing and returning the form.
