I think they will expect you to tick one of their boxes, having savings and assets in excess of £16,000 would be one of these but if you do not want to tick this write a letter that you do not believe you are eligible, don;t explain why and that you do not want to be assessed for ESA(IR).

I too have just received a Form ESA3(1BR) and for no apparent reason. A form which I would find impossible to complete as I don't know my partner's circumstances. I'm unsure even of my own circumstances since my sister deals with these, including DWP, matters. Nor would I wish to claim ESA(IR) as I am content with my contributions based ESA, ergo: don't see why this form is necessary. What should I say in reply in order to avoid asking my sister to complete (albeit only partly since my partner will not comply) this pointless and somewhat onerous form?

Is your sister your DWP appointee? If she is then she must deal with this form.

Have you read the link I provided earlier in this topic?

Are you sure that you do want to check whether you are eligible for the back-payments, they may be substantial?

Just write a letter explaining you do not want to claim and send it back with the ESA3 to the required address.

Thank you Gordon for your previous advice. Unfortunately other things in life took over and I never did reply to their ESA3 (IBR). I had a couple of reminder letters, the last of which stated " if you haven't returned the form because you have decided you wouldn't qualify ignore this letter - HOORAY.
Yesterday I had missed calls on both home and mobile phone from a number I didn't recognise - no message left on either. I don't reply to such calls for obvious reasons. Today received a letter stating they are coming to visit me on Monday (today is Thursday). Phone number is the local one that rang yesterday. It says phone straight away if you want to rearrange!! Letter asks for shed loads of financial information to be available for the visit. As in my previous post I would rather not be assessed We jointly have a little over £1600, hubby is retired but does a bit of freelance work occasionally to supplement the pension. If I get awarded this supplement I will have to notify the DWP every time he does any work to adjust the supplement! I have sufficient benefit for my needs and do not wish to br re-assessed. I intend to cancel this appointment , but can you advise what I say? Further shall I phone the local number or the 0800 number previously supplied in their letters (was on hold to 0800 number for half an hour today without success? Time is short to prevent them turning up on Monday. Your advise would be much appreciated

You may not have a choice, the DWP can require you to provide this information as a condition of your receiving your benefits but on the assumption that this is not the case, just be honest and explain that you do not want to be assessed for these back payments.

Call them on the number that was included in the letter.
