On ESA for 15 years and want to work advice please

Hi.
I have been in the support group for 15 years. I have just filled in the usual renewal ESA50 in October and today received a medical appt for Monday 28th Jan.

Since I filled in my esa50 a job offer has come up that I really think I can do as it from a dear friend and can work around my problems. I don’t think an opportunity will ever come up like this again as they understand my toilet problems and illness.
I really want to get off ESA as it’s not helping my mental health being at home all day and I am becoming like a recluse. Also the stress of forms and medicals are really taking a toll.

My big worry is that if I get this job and it’s confirmed before my medical appt is it ok the tell them I want to cancel my claim and not go to the medical. What happens if the job is not confirmed before my medical date, do I still go. I have a interview on wed but might not know till the week of my medical. I have already rearranged my medical as I has sickness bug on 11th jan when I should of had medical. But if I then cancel my claim after medical will they think I have been lying, although I have several consultants letter about my condition but they are now a couple of years out of date as the hospital discharged me as there is nothing more they can do to help me, I have started some new meds from my GP which help so much since I filled in my ESA50.

I so want to get back in the real world and with this job that’s come up I feel I can do it,cause if I’m not having a good day then I can just catch up another day as it’s very flexible hrs and I can work from home. It’s only part time.

What is the best way to let the DWP know I want to come of ESA and start work. Normally I would not worry but it’s all come at a awkward time with the medical coming so close to the job offer.
I think being on benefits for so long has got me paranoid about what they will think of me. Will they want to know what the job is and hours etc, or won’t they be bothered as long as I’m cancelling my ESA.

How does this sort of thing work.

Any advice welcome please

If you are working for less than 16 hours a week and your earnings are less than £125.50 then you can do Permitted Work and continue to receive your ESA, this will make it a lot easier for you to migrate from benefits to work. There is a guide to PW in the ESA section.

You can cancel the appointment once, so this may give you more time to sort out your working but if you do not attend the appointment then you ESA claim will be closed and this may cause you problems if the working results in your health deteriorating again.

So, I would close the ESA claim properly by phoning the DWP office dealing with your claim and following that up with a letter confirming that you are closing the claim from "date" so that
you can start work.

If the working causes you problems then you may be able to make a rapid re-claim of your ESA providing you do so within 12 weeks of your closing your claim but you may no longer be able to do this and will have to make a new claim for Universal Credit.

Thank for the reply.

I cannot cancel my medical as I had to cancel it 2 weeks ago as I had the sickness bug.

The only option I have is either going to the medical and then they will find me fit for work or I ring them on Monday ( the day of the medical) along with the DWP to cancel my claim and hope that I get the job. If not go onto job seekers.

If I go to the medical, will it still be ok to ring them and tell them if I get this job, or should I just wait till they send me a letter saying I am fit for work.

I am so confused and don’t know what to do for the best.

All I know is that I want to get rid of the DWP for good. It’s just the financial bit that’s holding me back. As I need the job to replace the benefit.

I just need normality to save my mental health, my illness Is hormone related and I’m coming of menopausal age so should improve. That why I feel ready for work now.

Have you looked at the Permitted Work option?

If you realistically think that you will be found Fit for Work, then closing your claim before the assessment would make sense, if you need to make a new claim, then although you will be starting from scratch there will be no impediment to your making the claim but if you are found Fit for Work then you will only be able to make a new claim for UC or ESA if you can show that your conditions have deteriorated or that you have a new condition that would reasonably result in an award.
