hi all.my mum suffers from fibromyalgia and other conditions and is very ill,we applied for dla 6 weeks ago.just received letter.high mobilty indefenity and no care.she had no medical we think this was just info from her gp.my mum needs constant care,they have said she can do everything that we have put on the form that she cant.was thinking of ringing them to look at it again,but have heard that she could lose the lot.can someone please advise on wats best to do.thanks

Hi,

It is true that if one asks the DWP to look again at a claim, or ask to go to a tribunal, there is a chance that the original decsion could be reviewed downwards or even cancelled. The chances are usually small but it is a consideration that should not be overlooked.

You have one month from the date of the award letter to ask for the claim to be reviewed or ask for a tribunal (as part of the tribunal process a review of the claim is carried out anyway).

It could be worth getting some face to face advice from a Welfare Rights Agency/DIAL/CAB to go through the claim in detail both to try to assess the relative 'safety' of the High Mobility award and assess the possibility of obtaining any care award.

You will need to do this relatively quickly due to the time limit on asking for a review/tribunal.

of over 150,000 claims for DLA where people asked them to look again has a name starting with S 3% ended up with nothing ..... in theory and IMO of course if the awarded has just been done there should be less chance of lsoing as the awarded is so new, where one asks them to look at it aging years down the road you could have got better and the part awarded might not be due anymore .. I asked them to look again after over 15 years.... you could of course write on the paperwork please only look at care

that said if you put anything in your care claim that brings into question your mobility they will look at it again

hi all,we phoned and asked for them to look at the claim again,they asked lots of questions over the phone about my mums care needs.well today got the brown envelope,we are really upset,they have still awarded high mobilty but taken away indefinate and awarded till 2013 and still no care.my mum had no medical by them and her gp supported her.how they can still say she has no care needs is just a joke.in the letter is says we can rink and ask them to explain and if we still aint satisfird can appeal,but we are afraid of losing all.it is so wrong the way they make the desisons.has anyone had this happen to them.

shame they did not give some care
indef or 2013 makes no differance as 2013 is when they start rolling out PIP

still not satisfied so i called them again as to why they are not giving any care when my mum is really entitled to somthing as she is so ill.i was given the choice reconsider or appeal,so i asked for them to look again as i said its like you are talking about a different person and not my mum,the lady also said it was so unusual for them to reduce the lenth of time of the award.fingers crossed.
also is this usual that you can ask them to reconsider again or is it that that have made a mistake?thanks
