Reporting Atos Healthcare HCP to NMC was created by rab1000
Following my ESA medical assessment in January 2010 at which the Atos Healthcare HCP showed no interest in my mental health, despite 3 no Section 2 under Mental Health Act and given 0 points I have
- lobbied my MP
- Atos Healthcare Internal complaints L1
- Atos Healthcare Internal complaints L2
- Independent Complaints L3
- Independent Case Examiner

In December 2010 I got so depressed I booked a flight to Dignitas Clinic in Switzerland.
I am now in the ESA Support Group and fighting to get the Atos HCP struck off

It is appalling that you were pushed into taking such action back in December - thank goodness you are now in the support group. Do you mind me asking if it was your complaint or the appeal process which led you to eventually being placed there? You must have been devasted to be given 0 points.

Did you take your complaint to ICE because you were unhappy with the way Atos dealt with it?

Did ICE give you clear guidance on what they have jurisdiction over? It is certainly within their remit to recommend compensatory type payments for severe distress etc if they identify maladministration (not following correct procedures/delays/being given wrong information etc) but am not sure if investigating poor medical opinion is within their remit?

(I will understand if you do not want to go into too much detail.)

I took a complaint to the Parliamentary and Health Service Ombudsman (PHSO) after ICE and ended up receiving compensation for the distress caused by maladministration on the part of Jobcentre Plus and Atos healthcare, and from ICE for the way they handled my complaint. I now wish i had contacted the General Medical Council as well so that they could have investigated the malpractice side of my complaint.

I wish you well with your complaint to the Nursing Midwifery Council (GMC equivalent for nurses rather than doctors) and hope you have people around you to support you with the lengthy and at times very stressful processes.

Are Mind aware of your experiences?

Generally there is not very much guidance out there on how best to approcah complaints about poor medicals/decisions etc. Perhaps contacting the PHSO by telephone for initial advice would at least alert them to the range of problems people are experiencing with ESA and the IB migration process.

Here goes with my 2nd attempt at getting a post through to you RAB 1000.Glad you stayed with us and fought on. I had similar experience and,having asked ATOS to get doctor to confirm he had clicked on the right buttons and all in the report was indeed HIS work,and not a mistake (zero points etc) they confirmed this, but sidestepped my request for an evidential trail i.e. descriptor's source/specific evidence e.g. words of claimant,observation, statement/s in claimants questionnaire/doctor's report etc etc. I wonder why? I will repeat my request under the F.of Info Act and see what transpires,as a prelude to further action against the medic involved and complaint to DWP etc. WHO or WHAT is ICE? Do I need to go there first?? RSVP Thanks.
