2nd refusal..and counting!

Hi, I wonder if anyone can help or advise me, i srtuggle daily with my conditions fibromyalgia, osteoarthritis, under active thyroid which may be cronic fatigue! tired all the time, i struggle to work 2 and half days a week, due to increased stiffness and pain....then when i come home i sleep. i have just been lucky enough to get a parking space next to the building that i work in, which is helpful. but feel i cannot carry on the battle much longer. my recent claim went to the doctor for a report. but still no luck. my sister currently helps me in the house. My partner helps me with other personal care issues. I recently had a bad fall as my leg gave way.....and still i am having bad luck with this particular benefit, if i can no longer work which benefit will i need to apply for? i will of course use g24 appeal form. thank you x

Although, DLA is an in work benefit, (you are allowed to work whilst in receipt of DLA)have you considered that something pertaining to your job is somehow conflicting with an award of DLA?.

Failure to receive an award of DLA, can unfortunately be down to how a claimant presents their case, rather than the claimant not being entitled to it.

Always remember it is the limitation/disabilities and needs as a result of a claimants conditions that must fit the criteria for an award of DLA, rather than the conditions themselves.

Have you thought of enlisting the help of an advice agency such as the CAB?.

If you wish to appeal, remember that you only have one month from the date of the adverse decision to do this.

With regards to what benefit that you could claim, if you became unfit for work. That would be ESA, you would obviously need a G.P. Med Cert (sick note/fit note) to state that you were unfit for work, and would then have to make a claim on an ESA1 Form, which can be accessed from here. :

You could only make a claim for ESA, once any entitlement to SSP had ceased.

Hi,
Thank you for your helpful comment, i will indeed take that on board. Had already been to the CAB but i think they did'nt help me as our joint income at the time was in the higher bracket...
