ESA50

Hi,I am currently trying to fill in the ESA50 form. I am sending extra information and was wondering if I say why I can't work or do I not mention this at all and just state my symtoms. I don't know if I should mention work or not. I was also wondering if my Doctor were to say he felt there would be a risk to my physical health if I were found not to have limited capabilty for work related activity would this be acceptable?

It is up to you to decide precisely what you wish to put on form ESA50, but the normal practice is to simply address the relevant questions on the form that apply to your circumstances.

If you wish to claim that you have limited capability for work-related activity, you will certainly need confirmation form your doctor that in his opinion you are likely to satisfy the exceptional circumstances criteria.

I wonder if they would take into consideration the Doctors view on this or maybe they would think it's up to them to decide that.

The ESA decision maker has to take all the evidence into account otherwise if you fail the WCA, or are not put in the group that you consider you should be allocated, this may form the basis of an appeal?
