ESA FROM NEXT YEAR was created by janis42
If legislation goes ahead next year and someone no longer qualifies for ESA- contribution based in WRAG group as they have already had it for a year or more then I believe this is to stop. However once this stops can you perhaps put in a fresh claim say 4 weeks later if your health does not allow you to work and this now starts off a completely new claim which will last for 1 year?

I'm afraid if you do not qualify for Income Related ESA, then you can only reclaim ESA(CB) if you meet the NI contributions criteria, this will depened on whether you have worked during the preceding three years and if so, how much.

by the time this comes although my husband had to stop work in April 09 he was in fact still an employee and paid up to May 10 - hopefully he may still quality for ESA if he puts in a new claim under contribution rates. I thought it was two years but if it is three years then he may just be okay. Thanks

The NI contribution rules are complex but basically:

NI Contribution Conditions:
You must have paid enough national insurance contributions to qualify for
contribution-based ESA . In general, you need to have actually paid 25 x class 1 or 2
contributions in one of the last 3 tax years; and have paid or been credited with 50 x
contributions in both the last 2 tax years.
The rules relating to deductions for pension and pension protection fund payments
are similar to the rules for incapacity benefit.
You can’t receive contribution-based ESA if you are getting statutory maternity,
paternity or adoption pay.
