Hello i'll try & give the quick version.

GP didnt fill in ESA113 properly, was very vague & ignored page 2 despite me going to see him before & discussing it.

I spoke to GP on phone & asked if he would do me a letter of support, to which he agreed.

Called surgery & asked for copys of paperwork from consulatant & was told they were not allowed.

my carer wrote to the surgery & quoted paragraph 20 of the department of health guide re giving patient info but signed it as if i wrote it as he fills in all my forms for me.

Picked up GP Support letter from surgery at a cost of £15.
I dont think I can even use the letter in my tribunal as it may actually be detremental to my case; He states my chronic fatigue is down to my mental health issues & my pain is only in my right knee. this totally contradicts me claiming to have me/cfs. Im livid, £15 for nothing! He told me I "probably" have me/cfs but there was no definitive tests.
Furthermore he wrote another letter to me saying that i may have copys of the consultants paperwork as i had put the request in writing but there would be a charge of £5 per sheet.
He states in this letter that the letter my carer sent (but in my name) showed an intelligence, dilligence & endeavour that would be conclusive with working under certain provisions. He continues that DWP perspective is determind on the ability to do "some" work, not "preferred" work.

I cant believe he has taken this stance.
My carer has now written him another letter explaining that it was him who wrote the SAR request, not me & also pointing out all my health problems on a day to day basis that he seems to have overlooked or did not realise the extent of.
not that it will do me much good now, unless he writes me another letter.

my psychiatrist was so much more helpfull, he did me a letter free of charge & pointed out the 5 Support group descriptors that apply to me, so i shall be using his letter & just hope they take that into consideration over my gp.

its now been 6 weeks since i was told i would be going to tribunal & still not heard when my date will be.
went to welfare rights today at social work dept & signed the form for them to represent me, but they wont even go into my case until i get a date.

sorry for the long post but i think its important we all keep each other up to date at all the stages of our ESA sagas to help each other & answer any questions we may have.

Hi Martin.

The more you write - the more i feel that your best option may well be to simply submit your psychiatrist's letter and request an urgent reconsideration, if you have not had one - or maybe even a second reconsideration if you have had one (they can only say no and the process would continue.)

Mods - are tribunal judges themselves allowed to make a quick early decision if a claimant or representative contacts them with a clearcut piece of medical evidence from a psychiatrist?

If a psychiatrist is stating you meet five support group criteria - i can't see any need for a further GP report. Trying to charge you £5 a sheet for copies of letters really is downright mean. Again - do you need them as it really does sound like your psychiatrist has the trump card.

I really cannot see how a decision-maker/tribunal judge could ignore the clear advice of your psychiatrist.

I would be tempted for you or your carer to write a very simple accompanying letter asking for a reconsideration to take place as soon as possible due to deteriorations in your conditions due to the distress caused by the original decision.

Obviously, you have to decide how to take this forward - maybe I am missing something and a mod could offer a better approach, as i am no expert on the appeal process.

If an appeal is made, the DWP automatically reconsiders the case. There is no need to apply separately for a reconsideration once an appeal has been initiated.

Hi Survivor

I think the crucial thing here is that the decision-maker has not yet seen Martin's very supportive letter from his psychiatrist.

There is more info in another thread, which i have only just spotted.

i intend to submit my psychiatrist letter for a second reconsideration to the DM, as you say they can only say no & the process will continue.

i wont be paying for anything more from my gp as its obvious he is not helping.

p.s. survivor iv already had a no from the DM on reconsideration of my appeal but they made the decision in 3 days & didnt wait for me to submit additional evidence even though i said on my GL24 i would only once i had been sent my pack of documents.
