May I ask the Moderators & Members their advice in their experiance please.

I appealed esa wrag & stated on appeal form i would submit additional evidence once i had recieved all my paperwork & took advice.

Got letter from DM saying they had reconsidered & not changed their mind & it was going to tribunal.

then got letter asking for additional info so they could make a reconsideration.

have written a complaint letter asking why the DM only allowed 3 working days before they reconsidered, i thought i was allowed 1 month to submit additional info?

and why was i sent a letter asking for the additional info, when i had already stated i would send this when i had seen all the paperwork.

and this letter was sent AFTER i had already been sent the letter saying the DM had not changed their mind on reconsideration,
The letters were obviously sent in the wrong order!

I am still waiting on a reply to this complaint.
I am also still waiting on a date for tribunal & my pack of paperwork (its now been 6 weeks)

so my question is this;
Should I send the fantastic letter of support my psychiatrist wrote for me as additional evidence?
im thinking that due to my complaint they may do another reconsideration?
If you think i should send it, should i send it to the District Manager who i sent my complaint to, or to the DM at DWP?

or should i wait & submit this to the tribunal board?

the lady at welfare rights said not to waste a stamp cause in her 11 years doing the job she has never known a decision to be changed at reconsideration.

The turnover rate at Reconsideration used to be very low and it used to be the case that unless you could acquire a new, and very significant piece of evidence in the limited timescale available, you were usually wasting your time.

However, this is no longer the case and many members have been able to overturn a WRAG Decision for the Support Group, I would therefore disagree with your advisor as to whether it is worth a stamp.

If you decide to send the letter, then it should be addressed to the DM dealing with your case.

so even though its been 6 weeks since she said no to reconsideration & i am now waiting on a tribunal date, i should still send it to her?

As far as I can see you lose nothing other than the postage by sending a copy to the DM.

If there is no Reconsideration, then you can just submit it to the Tribunal Service as evidence for your hearing.

i did exactly the same as yourself only difference being i sent my additional information direct to the tribunal service two weeks later i received word that the decision had been changed in my favour hope this is of some help to you

i would also send a copy to the tribunals service but i have not had anything through the post yet from them, no date or anything.
did you just look up your local centre or had you already had notification from them?
