I have been put on ESA WRAG from end December 2011. On Incapacity Benefit for a number of years. Today my local CAB have told me that time limit for receipt of ESA WRAG (contributary) from April will be protected for 12 months even if on ESA/Incapacity Benefit for more than 12 months. Can anyone confirm this??? Thanks.

It's not quite like that - time spent in the WRAG and assessment phase before April 2012 is expected to count towards the twelve months.

Here is an explanation of the 365 day rule and how it is expected to apply if the draft legislation goes through unamended.

This seems to be same as further phone call from local CAB today. Appreciate not yet full law but likely to be. Many thanks your help
