I asked dla to look at my claim again due to my mobility getting worse. I am on LRM and LRC. After 22 weeks they requested for me to have a medical by atos.On 29/11/11 i went for my medical and the doctor did not have any of my case notes with her just a form to fill in. She did not ask me about my typical day or ask about my mobility (even though i went in my wheelchair due to the pain i was in that day).She asked me questions about my care at night and what adaptions i had fitted in my home. I got the decison back on 6/12/11 saying my low rate mobility will be taken away from me on 11/02/12 when my current award finishes which i had to appeal for last year and won. So now I have appealed against the decision and requested SOR which i am still waiting for since 11/12/11. Can they do this to me even though it is my mobility that is getting worse.

Hi Nesey

I was sorry to learn of this. It seems that following your request for your DLA to be looked at, you lost it entirely following a Medical.

You have asked for a SOR and appealed. May I suggest that you look at the B&W guides on DLA in the members section, on claiming and appealing DLA -

Thank you for your reply.
I filled in my renewel application also and sent that back in november, i used the advice on here by each question, but they still have taken my mobility away. I have an appointment with a welfare advisor next week. As i disagreed with the medical report on some of the answers the emp had put, i have now made acomplaint to atos also. how long do i have to wait for a reply from them with there final answer?

The complaints procedure regarding ATOS is explained in this leaflet -

As you have appealed the appeal tribunal will hear evidence that you wish to put to them about the difficulties you have mobilising and any help you may need.

I you have followed the B&W advice to Appeal the decision in the first instance, it will reconsidered prior to being sent to tribunal. If it can be changed the appeal will not go ahead.

You will need to provide evidence of your difficulties. Using the B&W guides will assist you throught the process.

Your WRA will be fully conversant with the process.
