ESA 365 day nearing was created by Ian
Hi, got my letter telling me today my 365 days in CB WRAG ESA ends on 13th April {not very much notice} I don't think i will qualify for IR ESA due to pensions etc. I have just recently returned home from hospital after having another heart procedure and think i should qualify for the SG, any advise how i do this the DWP are sending me IR application forms but i am wondering if theirs a form or do i just send in a letter to inform them of my health changes.

Hi I,

If you wish to request a review of your current WRAG award because your health conditions have deteriorated to such an extent that you now qualify for The SG, or you now suffer different health conditions, you can either write a letter requesting a supersession/review of your WRAG award, giving details and evidence of why you feel that you now qualify for The SG.

You could also use a GL24 Form which can be downloaded from this page :

How to submit an appeal

If using The GL24, make it clear that you are requesting a supersession/review, and not submitting an appeal.

You should expect to receive a new ESA50, and your WRAG award will be looked at again, so there is some risk, as with an appeal :

Is there any risk to challenging a decision?

You may wish to review our : ESA Claims Guides

As the ESA WCA, and which group you are placed in has no bearing on which type of ESA you are entitled to, (IR ESA or CB ESA) you could fill in the IR ESA assessment form also.

This will probably be an ESA 3 Form :

bro 58 thank you, just another query, as i said in my previous post my CB ESA 365 day WRAG ends on 13th April and i have just recently been in hospital for another heart procedure so i have sent back to DWP a gl 24 but specifically asked for a review on my WRAG award as i now feel i should qualify for SG. Will they pay me the Assesment Rate while they reveiw my case or will i get nowt.

Hi I,

Once your 365 days entitlement to CB ESA runs out that is it. So you would not be entitled to CB ESA at Assessment Rate, just as you would not be entitled to CB ESA in The WRAG.

So unless you can qualify for IR ESA, as you correctly state you would get "nowt" whilst awaiting the outcome of the review to gain entry to The SG. The same would apply to CB JSA, so you couldn't even claim that.
