Possibly going on holiday abroad? ESA and DLA?

Hello,

I have some questions please.

Please can you tell me if I go abroad to a Non EU country ie USA for 3 weeks do I need to inform the DLA department? I get DLA Lower and middle rate.

Please can you tell me if I go abroad to a Non EU country ie USA for 3 weeks do I need to inform the ESA department? I get ESA Support group contribution based?

Please can you tell me if I go on holiday for 2 weeks in this country, England, where I am from do I need to inform the ESA department? I get ESA Support group contribution based?

Hi n1980,

With regards to ESA , you are supposed to inform The DWP, if you are going to be away from home "overnight" no matter where you are.

See the extract, and link below :

Travel Abroad ESA :

ESA Regulations 2008, Regulation 157 which covers disqualifications

157 (1)(d) “is, without good cause, absent from the claimant’s place of residence without leaving word with the Secretary of State where the claimant may be found.”

" Temporary absences :

If you are temporarily in another country, you can continue to receive either contribution-based or income-related ESA for the first four weeks of your absence, as long as you are unlikely to be away for more than 52 weeks."


With regards to DLA :

If you take a holiday abroad you can usually continue to receive your Disability Living Allowance for 26 weeks.

You should take into account that assumptions may be made if the mode and rigors of travel are contradictory to your awards of ESA or DLA.

Hello,

I have been offered to see some family/friends abroad, outside of the EU. I contacted the DWP and spoke to 3 different people and got three different answers and the 3rd person said also I should contact the International Pension Centre (IPC) to be certain so I did and they were very very precise that if I am outside the UK for more than 4 weeks in a NON EU COuntry my ESA contribution based would be stopped, however if I am not out the UK for more than 4 weeks regardless of whether I am in an EU country or a NON EU country that I DO NOT need to inform the DWP and my ESA would carry on as normal

They were very very adamant with this and said we deal with this alot, we understand the rules. I didn't want to be rude and ask them to put it in writing, and I was wondering if you think I should phone them again and ask them to put it in writing if I do happen to go abroad?

Hi N1980,

We can only advise with regards to the regulations that we are aware of.

Yes, you would be entitled to ESA for no longer than 4 weeks if temporarily abroad.

However, the issue that worries me is the fact that they are stating that you donot need to inform them.

Many members have informed the DWP, and have then gone abroad. The DWP are not saying that you can't go abroad, just that you must inform them.

Write to them, well in advance, if they need a form completed, they will tell you.
