ESA WRAG Query when 365 days comes to an end

I suspect my query is outside the remit of the Forum but thought I would post it anyway in case any other members had any knowledge of the issue or had experienced a similar situation themselves.

My friend (who has ME) lives in Spain and has Spanish residency, she was migrated from IB to ESA Support Group in 2011 and had just been reassessed again (with no medical) and this time put in WRAG with 21 points. She is going to appeal to be put in the Support Group and understands this could take some time to be heard. She is worried that her 365 days will be used up before her appeal is heard and that if her ESA payments stop this will affect her Spanish health care which she gets free under a S1 as she is in receipt of ESA from UK. She has called the DWP office in the North East that deals with ESA claimants abroad to try and find out the situation but all they will tell her is that she will receive a letter from DWP about 8 weeks prior to her payments ceasing explaining what will happen. She knows that when her payments cease she will be entitled to NI credits for State Pension but can't find out whether this will also cover her health care in Spain.

Would appreciate advice from any Forum members who may be in a similar position, however, fully understand if Mods decide the subject matter is outside the remit of the Forum.

Hi GAP,

I think that your friend would be best served by contacting the relevant authority in Spain and asking what will happen if/when ESA payment stops.

We do have some members who live abroad, so it is possible that someone will be able to help. However, I don't know how many of these people look in regularly...

Failing that, you could try posing your query on one of the Spanish Brit Ex-Pat forums.

If you put Spanish Brit Ex-Pat forums into your search engine, several come up.

Thank you Mrs Hurtyback and Bro58 for your replies , will advise her to do what you have recommended.

She did try to get some advice locally in Spain but I am not sure who from and with the DWP here not being very helpful she was panicking a bit. She has sent in her appeal and is really hoping she can get back into the Support Group again.
