I'm afraid I cannot tell you whether to pursue the appeal. What I can tell you is that, having already had an appeal heard, there is a low chance of being able to take this further anyway. I can only assume that the DLA person spoken to either did not know that your friend had already appealed or did not understand the system (the latter is highly likely as the call-centre staff are often poorly trained).

Your friend could phone DWP and ask for the 'prognosis' from the computer screen. This would give her an idea of when to expect reassessment. If soon, she might decide to wait until this comes round. If it is going to be a long time she might decide to ask for a 'supersession'. However, you should be aware that this would start the whole assessment process again, she should expect to receive another ESA50 and might be required to attend a face-to-face assessment. It is possible that this would result in another 'fit to work' decision, this would supercede the current tribunal decision.

As this is a complex matter, your friend would be advised to get one-to-one advice

Where to get advice?

or you could do a web-search for "benefits advice" + your area.

Nothing on this board constitutes legal advice - always consult a professional about specific problems
