Hello, wondering if you can tell me how successful a paper review is. I applied for DLA month's ago and was turned down. I asked for a review which I have to have in by Monday 15th. Unfortunately the medical folk I have asked for additional support haven't been very helpful. DWP said they hadn't heard from the Pain Consultant in the allotted time.......I contacted the secretary she said he filled the form in and sent it, ( he said) unfortunately he didn't enter anything in my notes nor did he hand them to the secretary to photocopy......I wrote him a letter asking for a letter of support.....reply was he sent the form in....

Community OT promised to send me a copy of assessment, she has now gone on holiday. My GP filled in the form, I managed to get a copy of it, not overly helpful, her replies were short and didn't go into detail....to be fair to her although a frequent attender I only bother the Dr for prescriptions referrals and sick notes.. She left on a mth's holiday the day after I saw her re the form, asking her for a letter of support would just have parroted what I had put down.

I have asked the DWP to resend the form to the Pain Consultant but don't know if they will bother. My form was quite detailed, at least I thought it was, there really isn't much more I can say apart from repeat myself......all I have is a copy of a letter I wrote to my GP re her replies, copies of taxi's I have to use constantly and a receipt from the OT equipment dept. I have older letter's much more detailed from 3 years ago, I could copy those but not sure if they would be accepted..... Do you think it is worth while to continue with this review with the info I have? Thank you in advance.

Hi p,

Whether this reconsideration is as the result you requesting it, or one that is carried out automatically when an appeal is submitted, your DLA claim will be reviewed by a different more senior DLA Decision Maker.

As it seems that your claim was denied, you have little to lose by carrying on.

Sometimes, if you have provided good evidence in the first instance, it can be enough to reiterate this for any reviewing DM.

You could also state that you have further evidence that you cannot obtain, as the individual involved is on holiday, and that you will provide it as soon as you have access to it.

Either way, if it is a requested reconsideration only, you can then appeal if unsuccessful, if it is an automatic reconsideration as a result of you submitting an appeal, then it will be sent forward to The Tribunals Service. You will then have a chance to provide any other evidence that you may not have access to at this time.

I don't know whether you used our DLA Guides when filling in your application, but it would do no harm to review them :

If you do not continue with this reconsideration/appeal, that will be your last chance with DLA, as all new claims will be for PIP.

'Old' evidence can be useful if you can also show that your condition would be expected to continue, or even worsen, over time. You should also explain why you have not 'adapted' to your condition.

Nothing on this board constitutes legal advice - always consult a professional about specific problems
