:( Hi everybody
Its a long time since I have posted but I look in everyday to keep myself up dated and would be most grateful if any one can help with my query January 2012 I requested a super session on my claim as my condition had become even more intense. My ESA stopped in Feb 2012 due to the new law and it was re instated in May I was put into the Support Group for one year April this year 2013 I was sent out another ESA50 i sent it back and on it I informed them that one of the conditions I have Lupus SLE had and still is making me very ill . This was backed up by a letter from my GP and Doctors at my hospital . June the 7th a letter arrived from the DWP saying I was no longer in titled to ESA . I rang them up and was told I had been put back into the work related group no mention of this on my letter the lady said that this was a standard letter!!!!!!!!!!!!! I wrote back to them and enclosed a GL24form and said I wished to appeal on the grounds that I did not consider the decision maker had taken full account of the severity of my conditions and how it affects me I have had the standard reply we will look at your case again etc my question is should I wait for the new decision maker to reply to me or should I now send off for all of my paper work which was used by the first decision maker on my claim .Sorry if my post is to long but I wanted to give you as much info as I could I forgot to mention that on my claim in 2012 and 2013 Atos have not required me to go for a medical they seemed to have excepted my info on their form

Hi g,

Unfortunately, you only get the 365 days entitlement to CB ESA in The WRAG once. Therefore, as it seems that you had exhausted it previously circa Feb 2012, so as you have again been placed into The WRAG, you would not be entitled to any further payments of CB ESA.

Have you filled in an ESA3 Form to financially assess you for IR ESA ?

I have not looked back at your historical posts, so this option may be ruled out by your personal circumstances.

You should have received a written decision notice informing you that you had again been placed into The WRAG, rather than a letter simply stating that your benefit was stopping.

Yes, you can again request the documentation used in coming to this recent WRAG award, now. see :

You should address any SAR, FAO The Data Controller at the benefits office dealing with your ESA. Write DPA 1998 SAR in front top left corner of the envelope.

Hi g,

Just to add,

If you are placed into The SG as a result of a successful reconsideration/appeal, your CB ESA payments will be reinstated and backdated from the date of the adverse WRAG award.
