ESA 50 on physical and mental health grounds

Hi,
apologies if I am repeating something someone else has asked but wanted to get my question in before the forum closes again I keep missing the times!!!!

I am completing the questionnaire on behalf of my son who has severe athetoid cerebral palsy with associated learning difficulties. Please can you advise as to whether I need to fill in both descriptors that of the physical health and those of the mental health? Initially I assumed I should fill in both but having read so much info I have become a little confused!!!!
Appreciate the website enormously and any answers to my query.

Hi jb,

If you feel that the limitation suffered by your son are relevant to the Mental and Physical Health sections of The ESA50, then provide information as appropriate.

Let ATOS and The DWP DM decide which are applicable or not.

If you fail to provide information that you consider to be relevant to your son's limitations, they cannot possibly be taken into account.

Hi jbug,

We always tell claimants to make the forms fit them, rather than the other way round. Although DWP have recently said that they will consider only problems caused by physical problems in the first section, and only problems caused by mental problems in the second, our advice continues to be that you should put as much information as you can wherever on the form it seems appropriate and let DWP sort if out.

The worst that can happen would be that they ignore what you have written, whereas if you don't include it you have made it impossible for it to be taken into consideration.
