Yes, if your savings and assets drop below £16,0000 then you would start to receive ESA payments.

While you are only receiving NI Credits you are not required to participate in Work Related Activity, if your ESA goes into payment then you would become eligible.

So if I do decide to claim ESA just for national insurance, how do I do the form. There is a large part you miss out for contribution based ESA claim. This large part I assume is the means testing part. So as I have more than 16000.00 then the means teasting part is irrelevant for now. So do I just do the form as if I am claiming CB ESA? If I still feel unable to work in a couple of years time and my savings have been used up and I have below the 16000.00 , I assume then I would have to give the means testing information ?

No! if you complete it as an ESA(CB) claim they will treat it as one and as you don't expect to meet the Contribution requirements, it will be rejected. You need to complete it as an ESA(IR) claim and detail all of your financial information.

Well I should make doubly sure I do not meet the criteria for contrib based ESA. I was a carer until Sep 13 and I know now there are special rules for carers that allow the rules to be relaxed for the first qualifying condition. I believe if my claim was backdated to Dec 15 I would meet the first condition because older tax years (any tax year , even a decade ago) can be used but alas I do not believe I would meet the second condition . If my claim was backdated to Dec 15, regarding this second condition, although I would have the 50 weeks credits/payments required in one year(12/13)I would only have 26 weeks for the other year(13/14). As I keep saying (SORRY!)had DWP informed me back in 2013 and 2014 about the special carer rule, I could have claimed and satisfied both conditions. Anyway do you think I am right that I definitely would not be eligible now?

The DWP will always check entitlement to ESA(CB) even if the claimant ticks the IR box on the form, include a letter explaining that you believe that you might qualify under the Carers rule.
