Good morning,

Husband/Carer finally got thru to the DWP last eve at about 5.40pm.
Spoke to a young lady who said that I shall remain in the SG and should receive a letter stipulating this at some point in time once it had been signed thus from a DM. Presently they are prioritising those who are migrating from IB etc to ESA and those on re assessments are being dealt with as and when.
Think this is a way of saying 'not looked at yet', but we shall see.

Good evening,

Well this morning a brown envelope was seen hanging in the letter box.

With dread I opened it and it was dated 4th July re ' Your claim for ESA'.

First page goes on to say ' A change in the ESA rate payable,
We have looked at your claim again following a recent change.
From the 4th July your ESA will be £xxxxx
This is because of ;
A decision on your capability for work. You have been placed in the SG
You meet the eligibility criteria for SG.
It goes on and on for 5 pages of what I am entitled to how much I shall receive, all the usual.

As we are awaiting a decision from a DM from the DWP I trust I can presume this letter is not an uprating letter but a letter of intent that I am in the SG after completing the afore mentioned forms etc.

Usual real confusing letter from cut n paste and trust my feelings are correct as this follows on from being told the previous week that I would receive a letter saying I am
in the SG.

Now I need to discover how long I have been placed in the SG for and how they came to this correct decision.

Please can you remind me of the format to receive such information from the DWP and whom to contact.

Contact the DWP office dealing with your ESA claim and ask the assessment report, it will be an ESA85 if you had face to face and an ESA85A if you did not.

Re National Insurance REF xxx
Subject Access request under the Data Protection Act 1998.
I received a letter dated 04/07/17 re my claim for Employment & Support Allowance - ESA, placing me in the Support Group. - SG
I wish to be provided with copies of all the evidence used by the Decision Maker – DM/ Health Care Professional - HCP in reaching the decision dated 04/07/17 from the letter I received in relation to my application and subsequent decision to be placed in the Support Group for employment and support allowance. This evidence should include:
The completed ESA85A form and LT54 form.
Any queries, requests for clarification, correspondence, memos, emails or other communications between the HCP and the DM in relation to my claim or any notes or records of conversations between the provider and the DWP and any medical evidence from HCP’s such as my GP or Consultant etc that they asked for.
Any other evidence considered by the DM in reaching their decision.
In addition, I wish to be provided with a copy of any worksheet, score sheet or any similar document which sets out which descriptors, exemptions or exceptional circumstances the D M considered applied and did not apply to me and any other documents which set out the justification for the decision reached in my case.
As the decision made was the correct one and placed me in the Support Group, I wish to be informed of the length of award, which I presume is for 3 years – the current maximum length of award, thus ending 04/07/2017 or longer, whereby under current regulations a further ESA50 will be forthcoming 8 weeks prior to that date, I am happy with the decision made.
I look forward to receiving the said statements of reasons and length of award in due course.
I am Mrs xxx's carer and husband and have completed this letter on her behalf.
