Well I got the letter saying that his Mandatory reconsideration made no difference to their decision. It states in her letter that what I wrote would make no difference so have not been addressed. I phoned the woman who had sent the letter, only luckily she was not there it was a different person at her desk because in the letter from the DWP it had a sentence in that was so untrue it was criminal.
The sentence was, "You (meaning my son) also advised the Health Care Professional that you had back pain as you had lifted your wheelchair into the car twice that day. This again supports your upper limb strength" THAT was not only a complete lie but there was no mention of that in the Medical Report (ESA85), the woman I spoke to on the phone also checked and said she also could not see any mention of that in the Medical Report. So we both wondered why the woman who typed the Notice put it in. I should have found your site earlier of course but I naively thought these people doing the assessments were honest people.

It is definitely worth raising this as an issue, but remember disputing statements like this will not result in an award, this will only happen by you showing that he meets the criteria to score points.

The next stage is for you to request an appeal.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

Thanks but what I filled in the form should have given him the points, it was only the 'inaccurate' shall we say, comments of the assessor which seem to have been taken notice of. At least now I have a letter from his GP which was missing from his first form written in March 2015. The GP mentions in her letter son's kyphoscoliosis and also congenital sacral hypoplasia.

I'll try and find the Submissions guide, I find these sites a bit difficult to use, sure it's my fault not the site. Just another question, when I fill in No.5 of the SSCS1 do I comment and refer to what is written in their reply to my Mandatory Reconsideration letter or to their Medical Report Form? I will look for your guide meantime. As you can imagine I am spending every minute of the day trying to write a reply to put on the form. I've tried to get a solicitor but there just seem to be none in my area stoke on trent doing this sort of work. Other places here CAB etc just seem to be too busy, I've bought a book which is supposed to tell me all I need to know and covers everything to do with benefits law, very useful for those who have a brain. ;)

The reasons you include in your SSCS1 can refer to content in your original claim form but I would avoid referring to anything you submitted as part of the MR at this time, as you are disputing the original Decision and not the MR Decision to uphold it.

That does not mean that you cannot repeat content from your MR letter on the SSCS1.

Every little bit of info is helpful. Thank you. This is part of a medical report from when son was 22 well over 20 years ago.The report was asked for by the DHSS (now DWP) from a consultant orthopaedic surgeon, I enclosed the whole of the old report, it was only four pages.
The report states that the prognosis as far as mr ******* is concerned is poor.
as time goes on the deformity will become progressively worse and secondary arthritic changes will develop in the spine associated with the inter vertebral disc spaces and facet joints and will render his spine permanently painful in the future and will add progressively to his disability and incapacity with the passing years. His capacity for work will not improve as the years go on and will become less and less.

These monsters just stopped his money, I phoned the DWP to tell them I had sent in a three month sick note and why did he not get any money and was told that until I receive a reply to my appeal, which I haven't finished yet, he will not get anything. Without us my son would be on the streets within weeks.
