I contacted lcoal Council Welfare Rights Advisor who rang me back and advised me to keep a diary, go through the Atos report line by line and put down my thoughts which I have done and emailed to him for review. Also he told me to call him and he would arrange to see me when the DWP evidence pack for the appeal arrives. So I am sort of in his hands at the moment.

So I filled in a Tribunal Appeal form a few weeks back and have received confirmation of the opening of a new appeal by HM Courts.

Today I received a letter from DWP saying they have all the information to make a decision. My impression from reading online of the procedure is I should next receive and evidence pack from DWP and the court will receive the same pack, instead I have got this letter.

Wonder if they made a mistake and someone pressed the wrong button and sent the letter or they plan to settle out of court?

Very confused.

Yes it does sound like it has been sent in error, you will have to wait and see.

You should not contact the DWP now about any issues with your appeal, rather communicate with them through the Tribunal Service.

Just had a letter from DWP appearing to renew my ESA giving rates of payment, does this mean I dont have to have an assessment for ESA?

From your post this sounds like the annual ESA Entitlement letter, if in doubt, check with the DWP.

Re-reading it, it says a rate change due to incoming money. All I can think of is my PIP being stopped which I am now appealing. On the 3rd page is has a top up amount because I am on contribution based ESA. All very confusing I will have to see if the level is any different on my bank statement as it says it starts 8th January this year.
