also, why should I start from scratch? THEY messed it up, THEY ended the ESA just because they think I haven't contacted them when I clearly did, and in every possible ways! THEY should start from scratch, THEY should waste their time and energy doing it all over again, I should not have to run around doing all the work providing new evidence and wasting my time doing
something that is absolutely unnecessary, as my health problems are still the same ones!

OK I understand how frustrating and annoying this is for you, but the only way you will be able to progress this matter is by playing by the DWP rules.

So although you have written to them once, you need to write to them again, you need them to tell you what Decisions, if any, have been made on your claim and how this effects your payments. All Decisions that the DWP might make, must be notified to the claimant in writing.

Whether you can pursue the matter legally or not, you cannot do so until you (a) understand what has happened and (b) have exhausted the DWP's own complaints procedures. you would be wasting your money at this time to engage the services of a solicitor.

thanks Gordon,

They said to the CAB that they sent me a letter on 18 December, but I didn't receive any decision letters. They said they resent it and that I should receive it this week.

Still, I never have been notified of the ESA suspension even before they ended the ESA. I would assume that when they suspend the claim for whatever reason, that they let the claimant now, let alone when they end the claim entirely because 'I haven't contacted them'.

The home visit letters read 'if you want to know more, contact us'. I thought 'know about what?' I had better things to do than play their guessing games. Of course, had I known that they had suspended ESA and that they were planning to end it, I would have contacted them. The problem was the complete lack of clarity in the 'home visit' letters.

I will of course follow your advice and I will send another letter asking what you mentioned in your reply. Thanks.

no, actually several times, if I include the complaints I made. I never received any replies. And they never notified me of any ESA suspension. Nor I received the letter they claim they 'sent'. It's now been 3 days since they said the 'resent' it, and guess what? I haven't received anything from them. I am quite sure I have done everything I could.

Is it true that once they end the ESA claim that the claimant must make a fresh claim? And it is so in both cases? Thanks.

If your claim has been closed and I stress the "if", then you would need to re-claim ESA, depending on the reason that the claim has been closed then you may be able to make use of a rapid re-claim providing the new claim is within 12 weeks of the old one being closed.
