Gordon,

In respect of the Nursing and Midwifery Council seeing they have now moved it to Case Investigation stage of the Fitness to Practise and in light of me having to give evidence to support my case, have you any experience in this before. Moreover it was suggested by the Case Handler I should seek my own legal representative now it has moved to this stage.

I'm afraid not, I know a couple of members have got this far in their complaints but they have not reported any further as to what happened.

Please be aware, As this appears to be becoming a legal situation, I may have to restrict the information that you post in the forum about this.

fully understand and already in the hands of my own Councel hence, as you suggest, I will leave the topic herein dormant until the case is heard and outcome defined.

Still awaiting for the Case hearing date to be finalised; according to NMC there is a unprecedented case backlog.

However, today I received an ESA50 which would tie in with a year since the last debacle.

The ESA50 is to be returned to the same Assessment Center as the Healthcare Professional whom I have the ongoing complaint with at the NMC.

Call me a pessimist but under the present circumstances I would not expect an unbiased Assessment should I be required to attend a face to face.

Do you believe I have grounds to move this to an alternative Assessment Center and/or even suspend such Assessment until the NMC case has been heard?

You can ask but be aware that this will use one of your two opportunities to attend, so try and agree on the new venue/date when you contact them.

I spoke to Maximus today as i was concerned since the NMC case is still open and i have to attend an Assessment Center where the Healthcare Professional who is under investigation is employed and was very politely told Maximus have dispensed with his services moreover, i was also told that unequivocally i can be assured of a wholly unbias assessment next week.
