Well my tribunal is now listed for hearing. They have allocated one full day to it. Not sure I will cope with that!

Never heard of one appeal being allocated a whole day. I rather suspect it won't last that long.

Yes well neither have I! Its also listed before the Regional Judge (as one of the members).

Anyhow thanks for all those who have contributed and given support to me throughout this very hard and difficult time in my life. Ironically the Social Services Department assessed my care need and allocated 7 hours direct payments!

Well received a telephone call today (Tuesday) to say that the Tribunal hearing cancelled due to matters outside their control. Will be relisted again 'in due course'. Its now neary 6 months since the Upper Tribunal Judge quashed the previous decision and remitted the case.

I await again with bated breath. Made a fresh application for DLA. Ive had a recent ESA medical done which was very helpful but surprise surprise the DLA claim was refused. The saga just continues: it's literally taken over my life and to top it all it took NINE MONTHS for a decision to be made on my IS claim and they still have not made a decision on my ESA(IB) claim made in September. I have contacted my MP about these latter issues but I really do start feel I am being persecuted here and left isolated.

I recently made an application for DLA and I had recently had a medical for ESA (I was awarded sufficient points for the work related group). I also had an EMP report done back in March which also was very supportive. Well needless to say DLA refused to make any award. I have had a long experience with them so it did not come as any surprise. I had in fact had a recent report done for other purposes that has identified the fact I have dyslexia and dyspraxia which I have had most of my life which I didn’t really realise as just took adjusted myself never thought about it in terms of potential care needs previously.

Anyhow the ESA report stated that I frequently forget or loses concentration to such an extent that overall day to day life can only be successfully managed with pre-planning, such as making a daily written lists of all tasks forming part of daily life that are to be completed.

In terms of execution of tasks he states that, “..takes more than one and half times but no more than twice the length of time it would take a person without any form of mental disablement to successfully complete an everyday task with which the claimant is familiar
In terms of initiating and sustaining action it is stated that ,”..cannot due to cognitive impairment or a severe disorder of mood or behaviour initiate or sustain personal action without requiring frequent verbal prompting given by another person in the person’s presence”.

The Doctors relevant features of clinical findings – abnormal – Appearance: Looks tired, (which clearly is consistent with the dreams and nightmares issue) ,Unkempt, wearing dirty clothes. Behaviour: Reduced facial expression (suggests depression). Mood: Current firm detailed plan for self-harm. Cognitive-General: Needing prompting at interview, Poor concentration on examination. Cognitive tests: Unable to complete five rounds of ‘serial sevens; (tests concentration, memory and thinking).
In terms of mental health the Doctor found as far as relevant
Tired: Looks tired
Build: Overweight
Grooming: Unkempt
Dress General Wearing dirty clothes
Tremulous : Present
Facial expression: Reduced
Coping at interview: Moderate difficulty coping at interview
Arousal: Agitated
Ideas of Self Harm : Current firm detailed plans for self harm
Prompting: Needed Prompting
Concentration: Poor


However on the basis of this report they decided no entitlement no wonder I get rather paranoid about DLA!!

Anyhow just thought I would give my recent experiences.
