hi Gordon.Thanks for your reply why do you say you wouldn't think I would be successful if the DWP don't reverse their decision and I go to a Tribrunal,

As regards my appeal I have given as much info as I can on a separate sheet informing them that I have conditions that have got worse since their esa interview I don't call it a medical as it was just question and answer time with the doctor typing my answers in.I have an appointment with my own doctor on Fri hoping he will give a report to DWP I have copied my appeal for him so that I wont take up much of his time, I have made sure that I have put how my conditions affect me and also why this appeal is 10 mths late as it is during the 10 mths things have changed for the worse.I have just read from your forum that doctors don't want to write to appeals,Im feeling again that its very hard to change their decision, any thoughts please

Hi Maz,

Although I cannot speak on Gordon's behalf, I suspect that he has made a 'typo' in his reply to you and meant to say that there is every reason why you should be successful!

You need to be aware that the Tribunal can only look at your condition as it was at the time of the Decision that you are appealing, any deterioration of your condition(s) since then must be ignored by the panel, their failing to do so would be an Error of Law and might well result in the DWP challenging any Decision that took the change into consideration.

If you think it would help, you can get a copy of your medical records from your GP, this may allow you to provide medical evidence without you being dependant on you GP, see
