The DWP are very insistent that personal independence payment (PIP) medical assessments are very different to employment and support allowance (ESA) medical assessments.

It is certainly true that the criteria for the two benefits are very different.  But the assessment method is very similar indeed, given that both require most claimants to fill out a form relating to the points system and then, in most cases, have a medical assessment using the same points based system.

Sometimes ESA medical reports are used as evidence when looking at PIP claims.  If this happens to you and you disagree with the decision on your PIP claim, it is important to argue that the legal tests are different.
