Employment and Support Allowance appeals

The DWP expect there to be an increase of 26,500 appeals a year, with 21,000 actualy reaching a hearing, following the introduction of employment and support allowance. This represents an increase of around one third on current incapaciity appeal numbers.

Refused ESA
Claimants who are found not to qualify for ESA will have a right of appeal. At the moment it is not clear whether claimants will have to claim Jobseekers Allowance whilst appealing, rather than having the option of claiming reduced rate income support - or income related ESA, as it will then be.

The DWP estimate that around 60,000 more people a year will fail the work capability assessment than currently fail the personal capability assessment. They believe, based on current figures, that a third of those who fail the WCA will appeal and that 70% of those who do so will reach an appeal hearing. This would mean an extra 20,000 appeals with 14,500 reaching a hearing.

Refused support group
Claimants who are awarded ESA, but only the work-related activity component, not the support component will also have a right of appeal.

The DWP estimate that around 6,000 people a year who are currently exempt from the PCA will not be placed in the support group and that all of these claimants will appeal.

Sanctions
Claimants whose ESA is sanctioned will have a right to appeal against that sanction.

The DWP expect around 0.5% of new claimants will have their ESA sanctioned, resulting in a further 1,500 appeals a year
