Have chosen paper appeal as I can't mentally cope with meeting and talking to strangers. Have received letter stating appeal has been received by the courts 27/12/2018. We have asked the DWP to prepare a written response to your appeal. This will be sent by them to you and the tribunal.
My query is do the DWP have any timeline or will it be sent when ever they get around to it. My assessment was in July 2018.

I did phone the DWP and explain that the Mandatory Reconsideration wouldn't alter their decision because all the information the decision maker would be looking at is incorrect. Examples: I go to town on a scooter not a mobility scooter so don't have mobility problems. Because I don't have a named mental health specialist I don't have mental health problems. All the history was wrong.

The DWP have one month from the date of the Tribunal Service's letter to complete and send a copy of the submission to the appeal, as you have opted for a Paper hearing, you will then have one month from the date of the DWP letter for the TS to receive your own submission, so I would start work on it now.

I'm a little confused. I have already sent a submission to the TS which they received on 27th December 2019 which was 28days from DWP letter. The TS stated that they have asked the DWP to prepare a written response to my appeal. A copy of the written response from the DWP will be sent by the DWP to me and to the tribunal Courts in Birmingham.
I was asking if the DWP had follow a timeline for preparing their written response to the tribunal courts.

All timelines to me have been met with don't know when it will arrive as we are inundated with work. I wondered if the courts allowed that response from the DWP.

The order of things is that you request an appeal, your request can include your submission.

Your request is forwarded to the DWP who have one month from the date of the TS letter to provide their submission.

You receive a copy of the DWP submission and as you have requested a Paper hearing, you have one month from the date of the DWP letter accompanying their submission for the TS to provide your submission or to provide any additional information that you want to send.

I have two questions
1) My previous assessment (August 2014) had to go to tribunal as it was full of mistakes and inaccurate information the same as my latest assessment (July 2018).
I was also originally awarded 8 points daily living and 0 points for mobility in (August 2014) and (July 2018).
The tribunal changed the awards to enhanced daily living and enhanced mobility. Could I use any of the comments from the tribunal paperwork from (2014) in my (2018) appeal?

2) Received a message from DWP today (09/01/19) stating "We've received the written report of your assessment. We will write to you once we've made a decision on your PIP. As a guideline you should hear from us within 6 weeks.

I'm assuming the written report of my assessment is the one I submitted in my appeal. The DWP have already made a decision twice. This is what I'm appealing against. I thought the courts make the decision.

1. Yes, you can include this information but you will need to explain why it is still relevant to your conditions as they are now.

2. We have seen this before, ignore the letter we think it has been sent in acknowledgement of the DWP receiving your appeal request but worded inappropriately.
