APPEALS PROCESS FIRST STEPS. was created by article
Had my head all afternoon in the Appeals documents the one from the DWP and the B@W 30 odd page one.

The latter page 8 QUESTION re- 'Where You Have Been Placed In The Work Related Group'.

Initially the scripted reply example given seems a bit light.!! Ive only had confirmation by phone today, not the written document.

Dont you reply to all the descriptors (4/5 in my case)where you feel youve been marked down (also wouldnt 2nd person checking right decision has been made have a better idea?).......

Should you go into a lot more detail on the appeals form??. And if appeal is turned down....


OR


Do you wait for A FULL COPY OF THE PAPERS (are these in the bundle) and then verbally debate your case at the tribunal or am I missing something here.

Would tribunal ask me about all the 4/5 descriptors I thought Id been marked down on?.

And just wondering If I should make something out of not having a medical.

Surely speaking to a ATOS Doctor about my mental health problem would clarrify my position so that the DM has a better idea before deciding on my fate??.

By lodging an appeal, you are starting a two part process.

First the DWP are required to carry out a Reconsideration of your claim, this is usually done by a different Decision Maker, who will review all of the evidence collected by the DWP, originally sent in by you, and any new evidence or submission that you provide now.

If this fails and there is no change to the Decision, your papers will forward all of these papers to the Tribunal Service to hold a hearing.

The arguments that it has been suggested you make when submitting the GL24, are primarily aimed at the DWP Decision Maker who will Reconsider your case. This process nornally take less than 11 weeks, and there is a limited period for submitting additional eveidence, about four weeks.

However, if you can turnover the Decision at this time, there is the potential to avoid waiting at least six month and possibly many more, before a Tribunal is heard, so makling an extra effort now, can pay dividends.

Of course, if this first stage fails, you will have an opportunity, both at the Tribunal hearing and in writing, before then, to explain in depth while you meet the 4/5 Support Group descriptors you believe you qualify for.

Hi Gordon,

Can you just clarify for me please. Am i right in thinking that once you have sent your GL24, you have a further four weeks thereafter,(from the date you submited on your GL24),to submit more evidence, which could be letters of support from
GP etc???

Hi Gordon,

So the second decision maker is in effect the person who you are making the appeal to, not a third person?.

And would you go into great detail here as to why you think the first person has got it wrong?.

A bit confused here because of the example on page 8 in the 30 odd page document where it says,

"but please do not ask me to provide further details as i will not be able to do so until I have been provided with a full copy of the papers etc"

Why wait till then?.

Gordon just a bit extra, are we also saying in effect the 2nd decision maker comes from the same department as the first decision maker, in fact they can be sat side by side as freinds on a daily working basis?.

And if this is the case what chance of a turnover of a pals decision???.
