LT54 & ESA65a

LT54 & ESA65a was created by greeneyedlad
after appealing wrag decision with no medical & being refused at reconsideration then sending in further evidence from my psychiatrist i was reconsidered again & was changed to support group.

my origional ESA65a when placed in wrag prognosis said 6 months.

i have recieved my new LT54 with the reasons for the change of decision why i was now placed in support group.
it states that after recieving my additional info the dm sought advice from atos & they confirmed that "there would be a substantial risk to my health if i was found not to have limited capability for work-related activity"

my question is this, would a new ESA65a have been done by atos when this "advice" was given to the dm?
as im curious to know if a new prognosis would now be given?

i sent a SAR request to DWP asking for all info including anything from atos & got loads of stuff in the post (mostly computer printouts that make no sense to me), but nothing from atos.

im not sure who to contact or what to ask for now. should a seperate SAR request be sent directly to atos?
id really love to see the new ESA65a if this was done as i want to know my new prognosis in the support group (hopefully longer than the origional 6 months so i dont have to fill in the ESA50 all over again soon)
surely a new ESA65a should have been done when they changed my status & backdated my money, especially when "advice" was sought from them by a dm?

any thoughts? many thnaks

Hi GEL,

I'm not sure what an ESA65A is, as I have never had reference to one.

If you wish to know where to send the SAR, you will have to make enquiries with either the DWP or ATOS.

Maybe one of the other Mods will be able to shed more light on the ESA65A issue.

No GEL,

That is an ESA85A, there is also an ESA65, please review :

ESA medical – what forms to ask for?

ESA Forms

If either of the above, then it would be the DWP that you send the SAR to.

We do come across members stating that they have received ESA Forms that we are not aware of, or had sight of.

Hi GEL,

In my experience of dealing with similar scenario's to your own, where the DM has changed a decision at review/reconsideration, there will not probably be another ESA85A. It is the DM that has reviewed all the evidenece, and made the decision to place you into the SG.

This is where the LT54 is used, and filled in by the DM.

Of course, I stand to be corrected.
