Atos and the Decision Maker was created by apples6
I am looking at some B&W ESA tip information and it says
in Heavy type re ESA50 along with send evidence as early as possible
....as often as necessary( not quite sure I understand that)
both to Atos and the Decision Maker please can you explain and clarify(nor understand that fully)
as with my ESA( for Migration)50 Form and letter it said to send the stuff (for my area) to one address Croydon which I guess? is Atos
how who and where is the decision maker located guessing they are DWP?
if that is case would you have to copy everything all over again and re send to a different address which as I say I do not know who where that is
thanks for detailed information and the reasoning

Hi A6,

You are only obliged to return the ESA50 to ATOS. at the address provided, by the deadline given.

However, many member have also chosen to send copy to the DWP DM, this is not obligatory.

Members choose to do this as a back up in case the ESA50 sent to ATOS is "Lost", therefore ensuring that the DM has access to it before coming to a decision.

To send a copy to the DM, simply address it : FAO The ESA Decision Maker, to the Benefits Office/Centre that deals with your benefits.

Your name, DOB, and NINO, as well as your postcode should ensure that it is diverted to the correct DM.

With regards to copying the ESA50, have you considered using the PDF ESA50 ? see :

Dear Mods
Please could you clarify something for me following apples6 posting. I had my medical in Jan 2011, I took relevant letters ,reports, from consultants with me, as did not have them all in time to send to Atos, At the medical the Dr refused to read them, citing time as a problem. I am due my next medical in November (as far as I know) my question is should I then enclose all relevant info (letters etc with my medical, plus a copy of them all to DWP as well. Thanks as I am still unsure after reading the posts.

Hi R,

It clearly states the following in the WCA Handbook at page 42, see extract :

"3.1.2 Reading the Documents

In preparation for the interview, you should read carefully the documents in the file /on MSRS. All the medical evidence should be considered, including any medical certification, Factual Reports, previous papers and other documents, including Tribunal documents. Particular attention must be paid to the current claimant questionnaire [ESA50] and all areas where the claimant indicates that there may be a problem must be fully explored. At times the claimant may also bring additional evidence to the assessment. Any evidence bought by the claimant must be read and the report should make reference to the evidence that has been considered and justification provided if there is a conflict between the opinion of the HCP and the other medical evidence.

Any evidence brought by the claimant, should be copied for the Decision Maker (see section 4.2.5 for further guidance)."

Your own experiences are good reason why it may be prudent to send copy of your ESA50 and any other evidence to the DWP DM, as well as ATOS.

At least then you will be sure that the DWP DM sees the above mentioned.
