virtually no info in SAR document

virtually no info in SAR document was created by vicki
Re my appeal against placement in wrag (CB). I received a reply to my SAR 5 months after I asked for it. I cannot believe a decision was made based on this. I have one sheet of A4 print out from an Atos HCP ( I never had a medical). It makes no sense to me at all. Containing nothing but a series of non related sentences, most of which indicate I have no problems with the activities I have clearly outlined fully in ESA 50 that I do have major problems with. She, (the HCP) then concludes that I am unlikely to work again! However more to the point I spoke to someone on the phone and it appears no points were attached to any of the descriptors and the lady I spoke to felt that it may not have been scrutinised by a decision maker.Am I to conclude that this was an administrative excercise and if so will the DWP really be sending only this sheet of A4 as their submission to the tribunal. I have not yet had confirmation that they have sent it to the tribunal and have been told that it may still be with the decision maker for reconsideration. With no points it makes it quite difficult to prepare for my tribunal, can anyone advise whether this could really be the case or should I contact them again to confirm no points were applied to the descriptors. thanks

Hi V,

You must have received at least 15 points cumulatively to be placed into the WRAG, unless you gained WRAG entry under Exceptional Circumstances, see :

thanks for that, so is it that they have just neglected to let me know how and where the points were applied and should they have included this in my SAR request?. Since I am appealing wrag to support group I think I need to know where points have been allocated and where they have not. Do I need to write again to ask for this information? thanks

Hi V,

Does it say anything similar to " has met the threshold of having Limited Capability for Work" (LCW) ?

Is it an ESA85 or ESA85A medical report that you have ?

I think you got the same piece of paper as I did (back in May) I was also told the....you must have scored 15 plus points to have got into WRAG(no medical) - where & for what God knows & told unlikely to return to work in the long term, again - why ? I'm appealing, couldn't argue their case as there wasn't one given but hope by appealing (ie sending the form back with everything underscored) someone actually reads it.

Hi Vicki

If you make a SAR to the DWP regarding a decision, it's preferable to request ALL of the documents relating to the decision rather than just the ESA85A.

The DWP's submission to the tribunal should contain a copy of your ESA50 and any additional information/medical evidence you sent, the ESA85A, and their reasoning for the decision, along with any counterpoints to your GL24 appeal letter.

Unfortunately I have never actually seen a filled in ESA85A, but from the example in the ESA handbook, there is no place to quote the points/descriptors, but there is a box headed I advise that the person meets the following for being treated as having limited capability for work. Perhaps the contents of this box may offer clues to the number of points scored?
