hello, another query please . iv recently been put in support group on appeal and have just received my back pay which is great as its really needed. i live with my grown up sons but am getting married at end of month. my partner has his own house at the moment. iv received a form to fill in asking about my sons wages, apparently this is because i receive £15.50 a week IR top up now.will my sons pay be taken into consideration with the back pay iv received and how is it likely to affect future payments. i realise it may stop altogether when im marriec...my partner doesnt work 24 hours but does earn around £6000 self employed thank you s

Adult children should not be included in your claim as they are not considered part of your household but there will be an expectation that they are paying rent and board which may have impact on your ESA(IR) and any Housing Benefit that you are receiving.

As always where financial matters are being considered, you should try to get face to face advice from a trained advisor, do an internet search for "welfare advice" with your postcode, town or county.

hello again
please can someone advise me.i was put in support group a couple of months ago and receive an ir top up.i got married 2 weeks ago and phoned dwp to tell them.i explained that im changing my surname but that my now husband will still not be living with me as his business(an old barn which has been converted into group accommodation which he co owns and co runs with his parents)is 75 miles away and he has to be there to manage it.im receiving £15.50 per week ir at the moment.the lady on phone said she'd send me an esa 3 to fill in which needs to be returned by end of month and that I should put a note in to explain the situation.i have made an appointment with a benefit advisor which is tomorrow morning.however on reading the form im wondering if its even worth applying to keep the ir esa part as its so complicated re my husbands work situation.he doesn't work over 24 hours a week and pays himself a small wage of £11,000 per year,but out of this he pays his mum and dads rent of £450 per month as he is living there.this leaves him with only £5600 year to live on but they do have some savings between them which they use to do improvements to the old building plus for holidays etc.
on the form it asks is your partner happy to do this as a joint claim?i don't think he is but it says if not to give as much info about him anyway.this seems intrusive when id just be happy to give the change of circumstances as changing my surname.or am I foolish not to try to claim ir?can I not claim just myself still?im very confused :S
I honestly don't know what to do for the best.please can you advise before I see the citizens advice tomorrow

The primary issue will be whether the DWP treat you as a couple or not. Your being married is part of the equation, but they will also consider your living arrangements.

The first thing to say is that your ESA(CB) is unaffected by whether you are a couple or not, the claim is in your name alone and takes no account of your husbands earnings.

If you are not treated as a couple, then your payments will remain the same, but you will need to notify the DWP immediately should your living arrangements change.

If you are treated as a couple, then your husband will have no choice but to provide the DWP with information about his income as he will be considered part of the claim and on-going payments of your ESA(IR) will be dependant on him providing any requested information. The DWP will be looking at you husbands income, I am afraid any deductions such as the his parents rent will not be taken into account.

You will receive extra allowances as a couple, but I have to warn you that I think likely that you will lose your ESA(IR) as a result of your husbands income. If you are receiving any other income related benefits such as Housing Benefit, these will also be affected by this change and you will also lose passported benefits such as free prescriptions and dental care.

just a thought Gordon.we've thought for a while that it might be better to get the accountant to change my husbands pay to not include the £5400 rent and just get it paid to his parents instead as he never sees this money it is paid direct debit to the landlady,so it isn't actually his anyway.with this lower amount of pay of £5600 per year is it likely still to result in my ir being stopped if they decide at any point to treat us as a couple(or if indeed we do buy a house together closer to the business in the future)
