Whether he is in the Government or not your MP has a responsibility to help their claimants with matters such as this, this is not something that would result in a conflict of interest.

Just ask ATOS if they have received the letter that your GP faxed them and have they changed their minds about a home assessment, if they say they are still refusing them tell them you have no other choice but to involve your MP.

OK telephoned the 0800 number for appointments and explained everything again. The lady there told me to ring the Atos centre and speak to a named lady, but if they didn't give me a decision by Friday I was to re-book the appointment else I will have problems.

I phoned the Atos centre but the named lady wasn't available. Another lady took my details and said they have got the fax but it's not been looked at yet. She told me the decision maker will let me know before my appointment. I told her it is on Monday and she got rather rattled and said "well we will either give you a decision or another appointment by then". I asked if I should ring if I have not heard by Friday and she reiterated they would send me a letter before my appointment.

I think I will go with the first lady's advice.

I did ask if they wanted any more evidence and she said no more, thank you in a way that sounds like they are snowed under.

Thanks for your advice so far - watch this space!

OK I have had no reply from that department at all and a week last Friday I telephoned late afternoon and was pushed from pillar to post - not us phone this department, etc. Eventually I goth through to another department who I had spoken to previously and the girl said they didn't cover my assessment centre. She gave me another number to ring and I tried this several times with no reply.

I then phoned the appointments department as per the advice on my post above. I spoke to a woman who went off to find some info but I got left on the line so long it just cut off. I then rang back and they have given me an appointment at the same centre in a very busy large town on a Saturday afternoon. Not really very helpful.

The second woman did say it gave me time to get anymore evidence in and I should have a reply from the decision maker soon. I explained that I actually can't get in and what would happen if my foot has a bad day and I can't actually walk on that day. She just said ring up and explain.

Anyhow, no decision from the decision maker.

Can I also ask if they do come to my home, that the interview is recorded?

Thanks for your support.

Unless the DWP now offer you a Home Assessment you must attend this new appointment or risk having your claim closed for failing to attend, this is an appealable Decision, but there is no guarantee of success and it may take some time before you hear what they will do, during which you will not receive any payments.

Apparently ATOS can record a home assessment, the equipment they use in their offices is portable and can be taken to a claimant home. You should make the request in writing, there is a template letter in the ESA Claim guides. Doing so may result in your new appointment being moved back as there is a considerable lead time for the recording devices to be available. I would make it clear that you want it recorded whether it is a home assessment or not.

As to your getting a home assessment, I am afraid there is nothing you can do but to continue to chase ATOS for an update.

OK thank you Gordon.

Sorry to sound dumb but what it the best way to ask for a recorded assessment? Should I telephone them or as has been previously said, email them?

Would you expect they will actually give me any decision? Or is this just a case of me having to guess? Sorry that sounds flippant but I can't know what their decision is if they don't tell me, can i?
