Hi

Can I just check on the rules for permitted work. I'm in the support group and I've been offered work for a fixed budge project. I would be paid about £20 per hour. Do I need to keep my number of hours to 5, so that I stay below the higher earnings limit - or can I average it (i.e. working say 8 hours one week and 2 the next - so one week is above £100 but the next is below).

You need to be extremely careful with this as breaking the rules for PW will result in your ESA claim being closed and you can only appeal on the facts of the matter.

The DWP can average variable earnings over a period of a month or even longer, but this must be agreed in advance and in writing, you must also ensure that even when averaged you do not break the income rules. If the DWP refuse to average your income then you cannot!
