My husband is in receipt of DLA care and mobility components higher rate, and is also in receipt of state pension and industrial injuries disablement benefit. This is our only income, as I was told last year that if I claimed JSA I would have to claim for him also. This was apparently not the case, but I haven't claimed since then due to what they told me at my local Jobcentre. I am under pensionable age, and able to work. Do you think I could claim any benefits which would not affect our current income? We are finding it very hard to make ends meet, but had to fight to get these benefits for him and I don't want to jeopardise them in any way.

JSA comes in two flavours, just like ESA does, to receive Contribution Based JSA, where your husbands income will have no effect you will need to have earned NI Contributions during the two Tax Years 2012-13 and 2013-14, in other words you will have to have worked during these two Tax Years.

JSA(CB) is only paid for six months.

If you are not eligible for JSA(CB) then you can claim Income Related JSA. Whilst there are differences in the rules from ESA, the income rule is substantially the same, so your husbands income; pension and Industrial Injuries Disablement Benefit (the DLA is not counted as income), will be deducted from the JSA. JSA is only £72.40. You may be eligible for some Premiums to be added to the JSA, such as the Disability Premium.

It is worth you checking the figures with one of the benefit calculators but I suspect that your income will exceed the JSA payments and therefore you would not be entitled to any JSA payments. That said it may still be worth you applying as you should still be entitled to NI Credits that count towards a full State Pension.

Obviously, whatever option is available, you can still seek and take work.
