Hi I'm wondering if you can help me please. I'm currently in the WOrk related group I also receive enhanced rate PIP care and also enhanced rate MOBILITY. I've recently been for a work focused interview. I've been on esa for many many years and PIP on last year.

The lady said I'm due a esa assessment and asked if I beleive anything else has changed from previous application form. I said yes greatly ! And she more or less "advised" I should be asking for a reconsideration of esa to be put into the support group.

I'm dreading writing a letter of reconsideration , how to word it , what to include can anyone help me please thank you xx

You have two options for challenging the Decision to place you in the WRAG.

You can ask for a Mandatory Reconsideration of the original Decision, this will be based on your condition as it was at the time that the Decision was made. You can only do this if the Decision was made less than 13months ago and will need to explain why the request is late.

If it has been more than 13 months or you are not sure that you met the criteria for the SG at that time and you can show that your conditions have deteriorated such that you now meet the criteria, then you can ask for your claim to be re-assessed.

In both cases you starting point is confirming that you meet one or more of the criteria for the SG, see our ESA Claim guides for more detail.

If you want to ask for your claim to be re-assessed then all you have to do is write to the DWP office that handles your claim and request a re-assessment on the basis of a deteriorated condition.

You need to be aware that in both cases there is a risk to your existing claim, whilst it would be unusual for your current award to be threatened it is a possibility and you need to factor this in to any decision you make about requesting a review.

Thank you for replying. When I went to my Interview the lady I see said they are a year and half behind on assessments , she said I was due to be assessed last January. But she asked if my health had got worst which it has dramatically and said I should ask for a new assmment to be done .
Is there a form I need to ask for or do I send a letter , I'm so clueless on how to word it

Forgive me for repeating myself, but the first thing you must do is see whether you qualify for the Support Group or not!

Not all of the ESA Descriptors have Support Group equivalents and if you qualified for the WRAG on one of these, then no deterioration will result in an SG award.

If you believe that you meet one or more the SG criteria then the next thing that you need to have is medical evidence that supports the deterioration, this might be as simple as increased medication but ideally should be a statement to this effect by one of the doctors treating you.

If you want to go ahead then all you need to do is write to the DWP office that deals with your claim and ask to be re-assessed on the basis of a deteriorated condition. Send the letter using a tracked post and keep the tracking information safe, as you will need this if there are questions about when the change applies from.

A re-assessment will likely result in a new ESA50 being issued and a face to face assessment, you need to treat this as a full re-assessment of your claim, so don't just concentrate on the change.

You remain in the WRAG until a new Decision is made and subject to any WFI or Work Related Activities that you might be asked to do.
