Good Morning,

I have recently placed a PIP SAR(Subject Access Request) with the DWP having now just requested an appeal with HMTCS. I have had a copy of my original claim form PIP2 & evidence posted to me however the lady at the DWP said she had to place a request for the PA4 Medical report etc. Do they have a time limit for sending out such info? Obviously I wish to see as my earliest opportunity to support my appeal.

Hi MM,

All SARs for personal information are covered under The Data Protection Act 1998. (DPA1998)

As such, The DWP have 40 calendar days from receipt of your SAR to provide the information requested.

DWP Data Protection Policy

We have heard from several members where DWP have failed to comply with the 40 days deadline.

The threat of a compliant to : The ICO usually does the trick.

Thanks for your prompt response, apologies as you had already supplied my requested info in your earlier response which you have gone into great detail. Really appreciate it , alot to take it and do at the moment. A little concerned as I have sent some recent evidence documents not recorded can I ask the DWP what documents they hold on evidence outright over the phone? Would this give them an opportunity to deny receipt?

Hi MM,

You could enquire over the phone, and they may be able to tell you which documentation has been scanned onto your file.

However, it can sometimes take 10-14 days for The DWP to electronically scan documentation that you send them onto your file.

Hi MM,

Yes, you should receive copy of any/all documentation that you have requested in The SAR, this should include any documentation that you have sent to The DWP.

I always advise that besides requesting particular named documentation such as The PA4 PIP Medical Report, PIP 1, PIP 2, etc, you should add a footnote stating that your request is pertaining to All documentation with respect to your PIP Claim Decision (ESA Decision, when pertaining to ESA) with your from-to dates covering just before the start date of you claim/transfer to present day.

This does away with the possibility of them not providing All documentation.
